The ninth circuit court has upheld a prohibition on sending national guard in the Oregon city, following a latest legal decision.

Judicial Panel Agrees to Rehear Legal Matter

The federal appeals court ruled on Tuesday that it would rehear the case concerning the executive power with an larger panel of 11 judges. The judicial body also overturned a previous ruling from a three-judge panel that had supported the administration.

Ongoing Dispute Over Troop Deployment

This order represents the most recent development in a protracted legal battle over whether the former president has the authority and justification to send state military units in the city. Approximately 200 federalized guard members have been in uncertainty since the end of September when the deployment effort was initiated in response to months of protests.

Differing Viewpoints

The administration has argued that government employees at the ICE facility in the southern part of the city were under attack, while city and state officials maintain that municipal police have command of the situation.

Contrary to descriptions of the city as “war ravaged”, residents have been posting footage of lush hiking trails and a thriving food scene, and organizing events such as an Emergency Naked Bike Ride against the increased military presence.

Recent Legal Actions

The appeals court decision came after a federal judge in Portland enacted two legal injunctions this period – one preventing the federal control of the state troops, and another stopping the use of any military personnel in Oregon, after efforts to evade the initial injunction by calling up out-of-state forces.

On Monday, the appeals court had temporarily suspended the initial decision – permitting control of state troops – but the second ruling remained in place, preventing the actual deployment of the forces.

En Banc Review

The latest ruling means the issue will be heard by the full court – with both rulings under review simultaneously – by a panel of eleven justices.

“This ruling demonstrates that the truth matters and that the courts are working to ensure government responsibility. The constitution limits the executive authority, and local populations cannot be treated as a training ground for unchecked federal authority,” said the state attorney general in a statement.

“The judicial body is sending a clear message: the president cannot dispatch the military into American urban areas unnecessarily. We will continue protecting Oregon’s laws, principles, and sovereignty as this legal proceeding progresses and our legal battle continues in the judicial system.”
